Ardawa -v- Uppal & Jordan [2019] EWHC 456 – Courts do not have the power to make a retrosp

Despite many solicitor firms asking process servers to letterbox the bankruptcy petition on their final attempt, and then making an application for a retrospective substituted service order, the High Court have ruled the Court does not have the power to make this kind of order.

The correct procedure has always been to provide evidence of evasiveness and request an order for substituted service. The Petition can then be letterboxed by Order of the Court.
